Notifications in Reserve+: does the message equate to official delivery.
According to ТСН: A new feature has appeared in the mobile application 'Reserve+' - users now receive notifications about the dispatch of paper summons via mail. However, the legal norms of notification remain unchanged.
Explanation from the lawyer
Lawyer Daria Tarasenko explained important aspects of this function and its consequences for individuals liable for conscription on social media.
She noted that receiving a notification on a smartphone is not considered an official delivery of the summons.
'Does receiving a notification in the app mean proper notification? No. The rule on what is considered proper notification is established by CMU Resolution 560. No changes to this Resolution have been made,' she states.
Freedom of choice
Tarasenko emphasized that users can independently choose whether they wish to receive such notifications, as this feature is optional.
'Refusal is set by default. Only if you want to receive such notifications can you enable this option in the settings. There will be no fines for ignoring notifications in the app,' she adds.
Legal aspects
The lawyer also reminded that notifications in 'Reserve+' are only a digital indicator of real actions by territorial recruitment centers. As she explains, representatives of TCK send summons via 'Ukrposhta' and enter data into the system, after which the application informs users. However, legal responsibility arises only in the case of actual receipt of the paper document.
'If the summons is sent to the proper address and received by you or returned to TCK with the appropriate markings of 'Ukrposhta', and you do not appear - this will be considered a violation for which there may be a fine in the future. Can there be a case where the notification arrives but the summons does not? According to the law, this should not happen, but in practice such cases may occur,' she concluded.
Thus, the option to receive notifications about the dispatch of paper summons by mail is now available in the 'Reserve+' application.
We remind that earlier it was reported that two new opportunities regarding deferments appeared in the 'Reserve+' application, which will be useful for individuals with temporary unfitness based on the results of the military medical commission and for families where one of the parents is military and has a child under 18 years old.
