Court Verdict in the Ternopil Region

According to TSN.ua: A court in Ukraine's Ternopil region has sentenced a 35-year-old man to three years in prison for evading military conscription. The Chortkiv District Court found him guilty under Article 336 of the Criminal Code of Ukraine. This case highlights the stringent enforcement of mobilization laws since Russia's full-scale invasion.

Case Details

In February 2023, the accused underwent a military medical commission, which deemed him partially fit for service. He subsequently received a summons to report to a training center in Kamianets-Podilskyi but failed to appear at the assembly point at the designated time. Although he was later sent to a military unit, he was returned due to what authorities cited as 'low moral and volitional qualities.'

The court rejected a defense request for exemption based on a 'change of circumstances.' It also dismissed the defendant's claim that 'vision problems' were the reason for his evasion, finding this version not credible. Consequently, he was convicted under Article 336 and received a three-year prison term.

This case serves as a clear example of the implementation of mobilization legislation in Ukraine.

This ruling is a stark demonstration of how Ukraine is applying its mobilization laws, which have become critically important during the ongoing war. Such judicial decisions regarding draft evasion carry significant implications for others in similar situations and for shaping public attitudes toward military duty.

It underscores that law enforcement agencies continue to actively address cases of evasion in an effort to meet the state's mobilization requirements.
