Both Intruder and Victim Sentenced in Unusual Home Invasion Case

According to TSN.ua: In a case that saw both parties punished, the Peremyshlyany District Court has concluded proceedings for unlawful entry into a dwelling. The defendant was sentenced to 6 years and 9 months in prison, while the victim was fined for repeatedly failing to appear in court. The incident occurred on April 5, 2025, when the defendant smashed a window with a hammer and forced his way into an apartment. He remained inside for approximately half an hour but stole nothing. This case highlights how procedural violations by a victim can lead to their own legal consequences.

The trial was complicated by the repeated absence of the victim, who failed to attend court hearings 14 times. It was revealed that the victim is a military serviceman who had deserted his unit and is currently wanted by authorities. For his non-appearance, he received a fine of 6,056 hryvnias.

The defendant, who had a prior conviction for robbery, was also punished for his actions. A prior sentence from the Sykhiv District Court of Lviv, dated September 26, 2024, had stipulated 6 years and 8 months of imprisonment. However, the final sentence imposed was 6 years and 9 months. Consequently, the court found both parties in the case guilty of breaking the law, assigning punishments according to their respective violations.

Case Conclusions

This case underscores the complexity of legal proceedings when both sides are found to have violated the law. The victim's absence from court and his status as a wanted military deserter could influence any further developments in the matter. Meanwhile, the sentence for the defendant reflects judicial practices regarding crimes involving unlawful home invasion and the impact of a prior criminal record on sentencing.
